Terms and Conditions

These Terms and Conditions govern access to and use of the website therapsy.it and the related Platform managed by Therapsy STP S.r.l., as well as the ways in which the Client may use the intermediation, organizational, and administrative support services connected to the therapeutic paths offered by the professionals who collaborate with Therapsy. The use of the Platform implies full acceptance of these Terms, which regulate every phase of the relationship between the Client and the Provider, from the request for information to the onboarding process, from matching with the Therapist to the technical and administrative management of sessions, up to the monthly billing of the services provided.


ART. 1 DEFINITIONS

For the purposes of this contract, the following definitions apply:

Service Provider: Therapsy STP S.r.l., with registered office in Milano 20141, Via Giovanni Battista Boeri No. 11, VAT / Tax Code: 14203210969b, a professional partnership company that manages the Platform;

Platform: the website therapsy.it;

Wise.live Application: used for onboarding activities, informed consent signing, document management, internal messaging, bookings and reminders, as well as any other digital environment made available by the Provider;

User: any individual who accesses the Platform;

Client: the individual who initiates a therapeutic path through Therapsy, completing the onboarding procedure and accepting these Terms.

Therapist: the psychologist, psychotherapist, or psychiatrist registered with the Professional Board who provides clinical activity in full autonomy and who acts as an independent data controller for clinical data;

Services: the intermediation activity, personalized matching between Client and Therapist, administrative management of the therapeutic path, internal messaging, management of bookings, consents and documents, online sessions via Zoom integrated into Wise.live, monthly invoicing via Stripe, and any other connected service.

Informed Consent: the document that the Client must digitally sign before therapy begins;

Onboarding: the mandatory procedure carried out on Wise.live including signing the informed consent and completing the billing questionnaire;

Messaging: communication exchanged through the reserved area of the Platform, a protected environment managed by Wise.live appointed as Data Processor under Article 28 GDPR.


ART. 2 OBJECT OF THE CONTRACT

This contract governs the relationship established between the Client and Therapsy STP S.r.l. when the Client uses the Platform to initiate, organize, and manage a therapeutic path with a qualified professional. This relationship has an exclusively digital, administrative, and intermediation nature, since the clinical activity is carried out solely by Therapists, licensed professionals operating autonomously and not employed by the Provider.

By accepting these Terms, the Client uses the Platform as a tool to be connected with an appropriate Therapist, to complete onboarding, to access the technical tools necessary for session execution, and to manage administrative, documentary, and payment procedures related to their path. The Provider ensures access to the Platform, technical and organizational continuity, and correct management of procedures, internal messaging, and connected digital systems, without interfering in the clinical relationship or therapeutic content. This contract does not regulate the clinical service, which is carried out independently under the Therapist’s exclusive responsibility; it instead governs the use of the site therapsy.it, the Wise.live application, integrated systems for online Zoom sessions, internal messaging, and administrative and payment services necessary for the therapeutic path.


ART. 3 DESCRIPTION OF THE SERVICE

The Services available on the Platform include a coordinated set of digital and administrative activities enabling the Client to access their therapeutic path in a simple, organized, and secure manner. The Client experience begins with a preliminary orientation phase, during which the clinical director or an assistant gathers essential information via an informal WhatsApp exchange, exclusively to understand the Client’s needs and to perform a correct match with the most suitable Therapist.

Once the professional is identified, the Client proceeds with onboarding on Wise.live, a mandatory procedure that includes digital signing of the Informed Consent, entry of billing information, and activation of the personal account. After onboarding, the Client may access Platform features, including appointment management, session calendar, automated reminders, and the ability to exchange messages within a protected area managed by Wise.live as Data Processor.

Sessions take place via integrated Zoom, except when the Therapist also provides in-person services. The Platform manages the first free session and subsequent paid sessions, which are recorded monthly and charged through Stripe to the payment method saved by the Client. At the end of the billing process, receipts are issued and stored in compliance with current tax regulations. Included within the Services is technical and administrative assistance provided by the Provider, supporting the Client in using the Platform, resolving technical issues, managing documents, using the calendar, and communicating with the Therapist through the available tools, excluding any clinical or healthcare activity.


ART. 4 ELIGIBILITY, REGISTRATION, AND ONBOARDING

To use the Platform and access the Services, the Client must meet the minimum legal requirements, including being of legal age and having the capacity to act; minors may access only with authorization and explicit consent from a parent or legal guardian, who assumes full responsibility for the provided information and activation of the therapeutic path.

Registration occurs through creating a personal account on Wise.live, the digital environment used to manage Informed Consent signing, tax data entry, session booking, and internal messaging. Registration requires authentic, complete, and updated data. The Client must safeguard their credentials and not disclose them to third parties.

Onboarding is mandatory and includes digital signing of the Informed Consent, completion of the billing questionnaire required by law, and confirmation of data necessary to deliver sessions. Missing, incomplete, or untruthful information prevents continuation or results in account suspension.

Once onboarding is complete, the Client may proceed with booking sessions, the free introductory session, and subsequent administrative and technical activities. The Provider ensures the Platform’s full operability, protection of personal data under applicable laws, and technical and administrative support. Using the Platform without completing onboarding does not allow initiation of therapy and does not entitle the Client to booking or messaging functionalities.


ART. 5 THERAPIST MATCHING AND NATURE OF THE THERAPEUTIC RELATIONSHIP, PRELIMINARY PHASE AND NATURE OF THE THERAPEUTIC RELATIONSHIP

The relationship with Therapsy begins when the Client fills out the form on the website, providing their name, difficulties they wish to address, past psychotherapy experience, email, WhatsApp number, city of reference, preferred session language, and any other information useful to understand their needs. The form is necessary to determine whether the therapy will take place online or offline and to gather essential information for proper Therapist matching.

After completing the form, the Client may interact on WhatsApp with the clinical director or an assistant. This exchange is orientational, not clinical, and helps clarify the Client’s needs, language, preferred mode, availability, and other elements necessary for accurate matching. WhatsApp must not be used to send health data, diagnoses, or clinical content.

Matching is not automated and does not use algorithms; it is based on personalized human evaluation by the clinical director, considering credentials, skills, experience, specializations, language, availability, and whether sessions are online or in person. Therapist profiles, qualifications, and price ranges are available on the site and vary according to the professional, service type, and chosen mode.

Once the Therapist is identified, the Client is invited to a first free call lasting up to thirty minutes. The call serves to meet, verify mutual fit, and decide whether to begin the therapeutic path. Subsequent sessions typically last forty-five minutes unless otherwise indicated.

The therapeutic relationship forms directly between Client and Therapist from the first free call. The Therapist operates autonomously, under professional and ethical standards. The Provider performs no healthcare activity, does not participate in session content, provides no clinical assessments, and cannot guarantee therapeutic outcomes.

The Client may request a different Therapist at any time. The Provider will reorganize administrative elements without interfering with clinical decisions.


ART. 6 SESSION BOOKING, CALENDAR, AND FIRST FREE SESSION

Sessions are booked through the Platform after onboarding and Therapist confirmation. The Client may view availability, choose times, receive confirmation, and consult the updated calendar. Reminders are automatic.

The first session is free, lasts up to thirty minutes, and is intended to allow mutual acquaintance and confirm whether the therapeutic path may begin. No billing applies to the free session.

Subsequent sessions, generally forty-five minutes, are billed according to this contract. The Client must attend punctually; delays do not extend the session.

Sessions may occur online via Zoom integration or, when available, in person. The Client accesses online sessions via an automatically generated link.

Connection quality, device functionality, and environment conditions are the Client’s responsibility. Connection issues do not cancel charges unless the Therapist decides otherwise.

Session rescheduling must follow the cancellation policy. Missed sessions without timely notice are charged.


ART. 7 SESSION CANCELLATION, PLATFORM ACCESS, AND MONTHLY BILLING

After matching, the Client receives an email with the Wise.live access link and a second email summarizing the service and instructions for onboarding. Signing the Informed Consent is mandatory; failure to sign blocks future sessions.

The Platform automatically detects whether the free call occurred and whether a paid session has been booked. Once a paid session is booked, it is counted for billing regardless of attendance.

Sessions must be cancelled or rescheduled at least 24 hours in advance. Late cancellations or no-shows are billed. Reasons provided by the Client do not affect billing unless the Therapist decides otherwise.

On the 1st of each month, the Platform compiles the previous month’s sessions—including those not cancelled in time—and processes payment via Stripe. Receipts are generated and stored on the Platform. Invoices are issued by the Therapist or their tax representative and reflect the rates published on the site.


ART. 8 PAYMENT METHODS

Session payments are processed through certified digital payment systems. During onboarding, the Client enters their payment method, which is stored by the external payment provider, not by the Provider.

Monthly charges occur on the 1st of each month based on the session summary. Charges apply even if the Client did not attend a session that was not cancelled correctly.

Failure to update or maintain a valid payment method results in suspended Platform access until resolved. The Provider is not responsible for issues caused by third-party payment systems.


ART. 9 SERVICE DURATION

The relationship has no minimum duration or renewal obligation. The formal start occurs after onboarding, signing the Informed Consent, and scheduling the free session. The Client may discontinue therapy at any time, subject to payment obligations for sessions already booked or not cancelled.

The Provider remains responsible solely for technical and administrative continuity. Account closure requires prior settlement of outstanding charges.

The Provider may suspend or terminate access for violations, improper use, or payment issues.


ART. 10 MESSAGING, COMMUNICATIONS, AND PLATFORM USE

The Client may communicate with the Therapist and Provider via internal messaging within Wise.live, which stores messages as necessary for service delivery. Communications must be relevant and respectful.

WhatsApp may be used only in the preliminary phase and must not contain sensitive or clinical information.

After onboarding, all relevant communications must occur within the Platform. The Client must use the Platform lawfully, avoid unauthorized access attempts, and refrain from improper or harmful behavior. The Platform may not be used for emergencies.

The Provider may suspend access for misuse or contractual violations.


ART. 11 WITHDRAWAL

A Client who qualifies as a consumer under Italian law may withdraw within 14 days from onboarding without providing reasons. Withdrawal does not affect sessions already booked or not cancelled.

The right of withdrawal expires upon completion of the first paid session. The free introductory session does not affect the right of withdrawal.

After the first paid session, the Client may discontinue the path at any time but must comply with cancellation and billing rules.

The Provider may terminate the relationship in case of violations.


ART. 12 CLIENT OBLIGATIONS AND PERMITTED CONDUCT

The Client must use the Platform correctly, provide accurate information, safeguard credentials, and use the system solely for their therapeutic path.

The Client is responsible for ensuring an adequate environment and technical setup for online sessions. Technical issues attributable to the Client do not invalidate billing.

The Platform must not be used for emergencies or inappropriate content. The Client must respect cancellation terms and payment obligations.

Violations may result in suspension.


ART. 13 THERAPIST OBLIGATIONS AND PROFESSIONAL AUTONOMY

The Therapist operates autonomously, following professional and ethical rules. The Provider does not supervise clinical activity.

The Therapist must conduct sessions with professionalism, maintain confidentiality, and manage clinical records as an independent data controller.

The Therapist must keep availability updated and comply with session duration, first free session rules, and cancellation policies.

The Provider may terminate collaboration with a Therapist in case of violations.


ART. 14 LIMITATIONS OF PROVIDER LIABILITY

The Provider ensures Platform operation but is not liable for:

  • technical issues beyond its control

  • clinical content or therapeutic outcomes

  • connection quality or device problems

  • issues caused by third-party providers

  • incorrect use of the Platform by the Client

Indirect or consequential damages are excluded.


ART. 15 INTELLECTUAL PROPERTY AND PLATFORM RIGHTS

The Platform, therapsy.it, Wise.live, and all related digital environments are protected by intellectual property laws. Content may not be copied, modified, or used without authorization.

The Client obtains no ownership rights and may use the Platform only for personal therapeutic purposes.

Any attempt to access source code, extract data, or imitate organizational processes is prohibited.

Clinical materials remain the property of the Therapist; technical and organizational tools belong to the Provider.


ART. 16 PERSONAL DATA PROCESSING

Data is processed in compliance with GDPR. The Provider acts as data controller only for administrative data and does not access clinical data.

Therapists are autonomous data controllers for clinical information.

Wise.live acts as Data Processor under Article 28 GDPR. Payment systems act as independent processors for transaction data.

WhatsApp is not used for clinical data.

The Provider applies appropriate technical and organizational security measures. The Client may exercise GDPR rights at any time.


ART. 17 COMMUNICATIONS, NOTICES, AND CONTRACTUAL CHANGES

Communications occur via the Platform or the email provided during registration. Notifications and updates are considered delivered once sent.

The Provider may modify these Terms if necessary. Changes become effective 10 days after publication unless otherwise required.

Continued use implies acceptance.


ART. 18 SUSPENSION, LIMITATION, AND TERMINATION OF SERVICE

The Provider may suspend or limit access for security, maintenance, misuse, violations, or payment irregularities. Suspension is immediate when required and remains in effect until resolved.

Repeated violations may lead to termination.


ART. 19 FORCE MAJEURE AND SERVICE CONTINUITY

The Provider is not liable for disruptions caused by force majeure, including network failures, cyber-attacks, natural disasters, or failures of third-party systems.

The Provider will restore service as soon as reasonably possible.


ART. 20 APPLICABLE LAW AND JURISDICTION

Italian law governs this contract.

Consumers may bring disputes before the court of their residence.
Non-consumers submit to the exclusive jurisdiction of the Court of Milan.


ART. 21 FINAL PROVISIONS

This contract constitutes the sole agreement between the parties. Invalid clauses do not affect the remainder.

The Client may not assign the contract without written consent. The Provider may rely on third-party collaborators.

Acceptance occurs by selecting the relevant confirmation box. By accessing the Platform, the Client declares to have read, understood, and accepted all provisions.
