Terms and Conditions

1. Parties and scope

These Terms govern your use of the platform operated by Therapsy STP SRL (“Therapsy”, “we”, “us”, “our”). We provide an intermediation platform that connects patients with licensed clinicians. The therapeutic service is delivered by the therapist, who is independent and solely responsible for clinical activities and clinical data processing.

2. Services

Therapsy makes available:

  • Psychotherapy (individual and couples), psychodiagnostic evaluations, and psychiatric consultations delivered by qualified, board-registered professionals;

  • Onboarding and matching with a suitable therapist;

  • Bookings & reminders via Wise.liveonline sessions via Zoom (or in-person where available);

  • Secure messaging/chat and document sharing (including informed-consent forms) within the platform;

  • Billing & payments via Stripe (typically post-sessionmonthly consolidated charges);

  • Compensation distribution to therapists for completed sessions;

  • Customer care via email, phone and WhatsApp (see §4).

The overall therapy duration cannot be predetermined. Goals and duration are agreed case-by-case and reviewed periodically between you and your therapist.

2.A Use of Wise.live, Zoom and Stripe

Our booking, scheduling, reminders, document management and certain operational records are provided through Wise.live. Sessions are conducted via Zoom through Wise.live integration. Payments and monthly charges are processed via Stripe using Wise.live’s API connections. These third-party tools provide technology only; no clinical advice. Card details are stored by Stripe, not by Therapsy. Availability or outages of these third-party services may affect ours (see §13). Processing is described in our Privacy Policy.

3. Eligibility and registration; informed consent

You must be 18+ unless a parent/legal guardian consents for a minor. To use the Services you must:

  • complete registration with accurate data;

  • accept these Terms and the Privacy Policy;

  • review and sign the Informed Consent before any psychological/psychotherapeutic/psychiatric service.

4. Support, phone line & AI voice assistant

Calling +39 393 433 1887 connects you to an AI voice assistant provided by Aptiva Srl (Italy) for customer care. It offers general information only and may invite you to use the website form or email. Do not disclose clinical or sensitive information by phone. The voice assistant does not solicit or store health data and is not an emergency or clinical channel.

5. Medical disclaimer & emergencies

Therapsy is not an emergency service. In emergencies, call local numbers (e.g., 112/118). The platform and its content do not replace medical advice. Therapists are independent professionals responsible for clinical decisions and outcomes.

6. Account, conduct & acceptable use

Keep credentials confidential; use services lawfully; no harassment, abuse, IP infringement or interference; no session recording without prior written consent of both patient and therapist and a valid legal basis; no unauthorized access attempts. We may suspend/terminate for violations or security reasons.

7. Booking, rescheduling & cancellations

Policies are shown during booking in Wise.live and form part of your contract.

7.A Cancellations and no-shows; late arrival

You may cancel or reschedule free of charge up to 24 hours before the session start time (unless a different window is shown at booking). If you cancel later than 24 hours before the start time or do not attend the session (no-show), the full session fee remains payable.
Sessions end at the scheduled time even if you arrive late; the full fee still applies. You agree to keep your contact details active and reachable for appointment communications.

8. Fees, billing & payments

Fees are displayed before confirmation. Unless stated otherwise, charges are processed after sessions, with monthlysettlement via Stripe to your saved payment method. You can update your card in your account at any time. Receiptsare issued at payment time.

Fiscal items (where applicable): a 2% ENPAP welfare contribution applies; a €2 stamp duty applies to invoices exceeding €77.47; healthcare services are VAT-exempt under Art. 10(1)(18) of Italian DPR 633/1972.

Invoices are issued by Therapsy STP SRLTransmission to the Sistema Tessera Sanitaria (TS) occurs only if you have opted in and as permitted by law.

9. Privacy & data protection

Your use of the Services is governed by our Privacy Policy and Cookie Policy (footer). They explain roles (Therapsy controller; therapists independent controllers for clinical data), purposes, legal bases, retention, international transfers, cookies/CMP, and your rights. Security and data breach handling follow our Privacy Policy. You may report a suspected breach to info@therapsy.it.

10. Therapists’ independence & liability; termination of therapy

Therapists are independent (board-registered and insured). They are solely responsible for clinical practice and comply with professional rules. Therapsy is not a party to the clinical contract, nor responsible for clinical outcomes.
You may terminate the therapeutic relationship at any time by informing your therapist; a concluding session may be held. The therapist may also propose termination if no current or reasonable future benefit is expected and will, upon request, refer you to more suitable options.

11. Platform content, messaging and materials

Platform messaging/chat and document sharing are provided for legitimate therapeutic and administrative purposes only. You must not upload unlawful, harmful or infringing content. Where documents (including informed-consent forms) are exchanged, you agree to review and retain copies for your records.

12. Third-party services

We integrate third-party tools (Wise.liveZoomStripeActiveCampaignGoogle Analytics 4Microsoft ClarityGoogle Tag ManagerGoogle AdsMeta (Pixel/Ads), and Aptiva Srl voicebot). Their terms may apply. We are not responsible for services we do not control.
We provide the EU Online Dispute Resolution (ODR) platform link for consumers: https://ec.europa.eu/consumers/odr.

13. Availability

We aim for high availability but do not guarantee uninterrupted service. Maintenance, updates or third-party outages (Zoom, Wise.live, Stripe, telecom networks) may affect availability. We act diligently to restore service.

14. Warranties & limitation of liability

Services are provided “as is/as available” to the maximum extent allowed. We disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We are not liable for indirect, incidental, special or consequential damages, loss of profits/data/goodwill, or clinical outcomes (therapist’s responsibility). Nothing excludes liability where not permitted by law (including consumer law).

15. Indemnity

You agree to indemnify and hold Therapsy harmless from claims, losses or damages arising from your unlawful use of the Services or breach of these Terms.

16. Amicable resolution & governing law / jurisdiction

Before going to court, the parties will attempt an amicable resolution within 30 days of a written notice describing the dispute.
These Terms are governed by Italian law. If you are a consumer, disputes may be brought before the courts of your place of residence or domicile. Otherwise, exclusive jurisdiction lies with the courts of Milan, Italy. ADR/ODR may be available.

17. Force Majeure

Neither party is liable for delays or failures caused by events beyond reasonable control (including outages, acts of God, epidemics, war, government actions, or failures of telecommunications or third-party platforms).

18. Assignment

You may not assign these Terms without our prior written consent. We may assign these Terms to an affiliate or in connection with corporate transactions.

19. Severability

If any provision is held invalid or unenforceable, the remainder remains in full force and effect.

20. Changes to Terms

We may modify these Terms for legal/operational reasons. We will notify you before material changes take effect. Continued use after the effective date constitutes acceptance; otherwise, you may close your account.

21. Termination

You may close your account at any time. We may suspend/terminate for breach, fraud, non-payment or legal/security reasons. Termination does not affect accrued payment obligations.
